These terms are a translation of the French original. In the event of any discrepancy, the French version prevails.


1. Hotel details

The online booking engine is operated by Thaïs.


2. Purpose scope

These terms conditions of sale govern all bookings of rooms services made with Hôtel de Monaco, through any channel: the official website, telephone, email, in person at reception.

Every booking implies full unreserved acceptance of these terms. The guest confirms having read them before validating the booking.

Bookings made through a travel agency, tour operator online travel agency are subject to the specific terms negotiated with that partner, which prevail over these terms in the event of conflict.

Group bookings (5 rooms more) are governed by a separate contract do not fall within the scope of these terms.


3. Booking

A booking becomes firm only once the hotel has issued written confirmation, sent by email to the address provided by the guest.

The guest must be at least 18 years old have the legal capacity to contract. The guest warrants the accuracy of the information provided at the time of booking, in particular their identity, contact details stay dates. The hotel accepts no liability for the consequences of incorrect incomplete information.

Valid photographic identification may be requested on arrival, in accordance with applicable regulations.

Special requests (floor, view, twin beds, early arrival) are recorded on an indicative basis cannot be guaranteed.


4. Rates

Rates are expressed in euros, inclusive of all taxes, per room per night, for the number of guests stated at the time of booking.

The applicable VAT rate is the one in force on the date the service is provided: 10% on accommodation breakfast, 20% on alcoholic beverages. Any change to the statutory rate will be reflected in the prices.

Displayed rates are dynamic vary according to dates, availability length of stay. The applicable rate is the one confirmed at the time of booking cannot be revised thereafter.

Unless otherwise stated in the selected offer, rates include accommodation, Wi-Fi access all taxes except city tax. They do not include breakfast, bar consumptions, services on request (laundry, transfers, car hire).


5. City tax

City tax is collected on behalf of the local authority is never included in the rates quoted. It is charged per person, per night, is payable on site on departure.

The amount, set by the competent local authority, is €2.28 per person per night for a 3-star establishment. Guests under 18 are exempt.


6. Payment

At the time of booking. A valid credit card is required to guarantee every booking. No charge is made at this stage for flexible rates.

Non-refundable rates. The full amount of the stay is charged at the time of booking. This amount is non-refundable under any circumstances.

Flexible rates. Payment is made on arrival on departure, as indicated at the time of booking.

Accepted means of payment: Visa, Mastercard American Express, cash within the statutory limit, bank transfer subject to prior agreement.

The hotel reserves the right to refuse admission where the credit card is invalid, expired declined.

Any sum unpaid when due will automatically incur late-payment interest at the enhanced statutory rate, without prior formal notice, together with a fixed recovery charge of €40 for business customers.


7. Amendment cancellation

The applicable conditions are those of the rate selected at the time of booking, as set out in the confirmation.

Flexible rate: free cancellation amendment until 18:00 local time on the day before arrival. After that time, the first night is charged.

Non-refundable rate: no cancellation, amendment refund is possible, for any reason.

No-show. Failure to arrive on the scheduled arrival date without prior cancellation results in the first night being charged releases the hotel from any obligation for the remaining nights.

Early departure. Any stay shortened after arrival remains payable in full.

All cancellation amendment requests must be sent in writing to reception@hotel-de-monaco.fr. They take effect on the date of receipt by the hotel.

Cancellation by the hotel. Should the hotel be unable to provide the room booked, it undertakes to rehouse the guest in a nearby establishment of equivalent higher category, to bear both the difference in rate the transfer costs. This obligation does not apply in cases of force majeure.


8. No right of withdrawal

Under article L221-28, 12° of the French Consumer Code, the statutory right of withdrawal does not apply to accommodation services provided on a specified date for a specified period. Every confirmed booking is therefore subject to the cancellation conditions of the rate selected.


9. Check-in check-out

Check-in: from 15:00 until 20:00. Check-out: between 08:00 11:00.

Any arrival expected after 20:00 must be notified to the hotel on the day at the latest. Without such notice, the room may be released for sale from midnight, the night remaining payable.

Early check-in late check-out may be granted subject to availability, where applicable for a supplement.

Occupancy beyond 11:00 without prior agreement may result in an additional night being charged.


10. Conditions of stay

Occupancy. No room may accommodate more people than its stated capacity. The hotel reserves the right to refuse access to any person not declared at the time of booking.

Non-smoking establishment. Smoking vaping are strictly prohibited throughout all indoor areas, in accordance with French decree no. 2006-1386. Any breach will result in a cleaning restoration charge of €250.

Pets. Pets are welcome subject to availability, for a flat supplement of €10 per animal per stay, payable on site. Guide dogs assistance dogs are admitted free of charge without restriction.

Quiet enjoyment. Guests undertake to respect the peace of other occupants, in particular between 22:00 08:00.

Damage. Any damage, loss disappearance of equipment will be charged to the guest on the basis of the replacement repair cost. The hotel is authorised to debit these amounts from the credit card registered at the time of booking, after informing the guest.

The hotel reserves the right to terminate a stay, without refund, in the event of conduct contrary to public decency, public order these rules.


11. Liability

The hotel's liability for items deposited by guests applies within the limits set out in articles 1952 to 1954 of the French Civil Code. Valuables, cash documents must be placed in the in-room safe; failing this, the hotel accepts no liability for loss theft.

Parking is on the public highway adjacent to the hotel. The hotel has no private car park accepts no liability for vehicles their contents.

The hotel cannot be held liable for temporary service interruptions (Wi-Fi, water, electricity, air conditioning) arising from external causes necessary technical work.


12. Force majeure

Neither party may be held liable for failure to perform its obligations as a result of force majeure within the meaning of article 1218 of the French Civil Code. In such circumstances, obligations are suspended for the duration of the event; should it continue beyond 30 days, either party may cancel the booking without compensation, sums already paid being refunded in proportion to the services not provided.


13. Personal data

Personal data collected is processed in accordance with Regulation (EU) 2016/679 (GDPR) with the hotel's privacy policy, available on the website.

It is used to manage bookings stays, for invoicing, to meet legal obligations , subject to consent, to send commercial information. It may be shared with the hotel's technical providers, in particular the Thaïs property management booking system, with payment providers.

Guests have the right to access, rectify, erase, restrict, object to port their data, which may be exercised at reception@hotel-de-monaco.fr. Guests may also lodge a complaint with the CNIL, the French data protection authority.


14. Complaints mediation

Any complaint must be sent in writing to reception@hotel-de-monaco.fr within 30 days of the end of the stay. The hotel undertakes to respond within one month.

Under articles L611-1 et seq. of the French Consumer Code, a consumer who has not received a satisfactory response within that period may refer the matter free of charge to the consumer mediation body to which the hotel subscribes:

A referral to the mediator is admissible only after a prior written complaint to the hotel, which the consumer must be able to evidence. It must be made within one year of that complaint.


15. Governing law jurisdiction

These terms conditions of sale are governed by French law.

Failing amicable resolution, any dispute relating to their interpretation performance falls within the jurisdiction of the courts of Nice. This clause is without prejudice to the rules of jurisdiction protecting consumers.


16. Amendments to these terms

The hotel reserves the right to amend these terms conditions of sale at any time. The terms applicable to a booking are those in force on the date of its confirmation.
